These Terms of Service ("Terms") govern your use of the iOS app Spank Phone: Slap Your Phone ("the app"), provided by AlbosApps ("we", "us"). Please read them carefully.
1. Acceptance of the Terms
By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app. Apple's Licensed Application End User License Agreement (Standard EULA) also applies to your use of the app. If these Terms and the Standard EULA conflict, the Standard EULA prevails to the extent required.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for your personal, non-commercial entertainment, as permitted by the App Store usage rules.
3. Acceptable use
You agree not to:
- copy, modify, reverse engineer or redistribute the app, except where the law expressly allows it;
- manipulate the slap counter or the leaderboards through automation, cheating or exploits;
- use names or content on the leaderboards that are offensive, hateful, impersonate others or infringe anyone's rights;
- use the app to harass, hurt or embarrass other people without their consent;
- use the app in any unlawful way.
We may remove leaderboard entries that break these rules.
4. Your device and your safety
The app is designed to react when you slap the back of your phone. You use it at your own risk and you are responsible for your device and your surroundings. Slap gently with an open palm, keep a firm grip, use a protective case, play over a soft surface and never slap a damaged phone. We are not responsible for any damage to your device or to people or property resulting from the way you use the app. See our safety guide.
5. Purchases and subscriptions
The app may offer in-app purchases or subscriptions. Where it does:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your App Store account settings (on iPhone: Settings > your name > Subscriptions). Cancelling stops future renewals; the current period stays active until it ends.
- Free trials, if offered, are handled by Apple. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
- Refunds are handled by Apple according to its policies. You can request one at reportaproblem.apple.com.
Prices and what is included are shown in the app and on the App Store before you buy.
6. Intellectual property
The app and all of its content — including sounds, facial expressions, illustrations, texts, the name "Spank Phone" and the logo — are owned by AlbosApps or its licensors and are protected by intellectual property laws. These Terms do not transfer any of these rights to you.
7. Disclaimers
The app is provided for entertainment purposes, "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including that the app will be uninterrupted, error-free or that it will detect every slap. Leaderboards and features may change or be discontinued.
8. Limitation of liability
To the maximum extent permitted by law, AlbosApps will not be liable for any indirect, incidental, special or consequential damages, or for any damage to your device, loss of data or loss of profits arising from your use of, or inability to use, the app. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer.
9. Termination
You may stop using the app at any time by deleting it. We may suspend or end your access to the app or to the leaderboards if you break these Terms. Sections that by their nature should survive termination will continue to apply.
10. Changes to the Terms
We may update these Terms from time to time. The "last updated" date at the top shows when they were last changed. By continuing to use the app after changes take effect, you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of [COUNTRY — to be completed by AlbosApps], without prejudice to the mandatory consumer protection rules of the country where you live.
